Terms of Service

1. Acceptance of Terms

By accessing or using PicksHub ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

PicksHub is a platform for hosting and participating in NFL Pick'em pools. We provide the infrastructure for pool organizers to manage their pools and for participants to submit their picks. We do not handle participant entry fees directly.

3. User Eligibility

You must be at least 18 years old to use this Service. By using PicksHub, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms of Service.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account

5. Pool Hosting and Participation

For Pool Organizers:

• You are responsible for setting and communicating pool rules to participants
• You must comply with all applicable laws regarding contests and gaming in your jurisdiction
• PicksHub charges a hosting fee for active pools as specified during pool creation

For Participants:

• You must comply with the rules set by the pool organizer
• Entry fees are handled directly between you and the pool organizer
• PicksHub is not responsible for disputes regarding entry fees or prizes

6. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Create multiple accounts to manipulate pool results
• Use automated systems or software to extract data from the Service
• Impersonate any person or entity

7. Payment Terms

Pool hosting fees are processed through our payment provider (Stripe). By activating a pool, you agree to pay the specified hosting fee. Fees are non-refundable once a pool has been activated.

8. Intellectual Property

All content on PicksHub, including text, graphics, logos, and software, is the property of PicksHub or its licensors and is protected by copyright and other intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL PICKSHUB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless PicksHub and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. You may delete your account at any time through your account settings.

13. Governing Law

These Terms shall be governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use constitutes acceptance of the modified Terms.
